1. Information

Basic rules of coaching / training

Confidentiality: All information we receive from our clients will be kept strictly confidential. Clients should feel safe to discuss their personal and professional matters openly.

Acceptance and respect: A non-evaluative and non-judgmental environment is crucial.

Self-determination of the client: The responsibility for decisions and actions always lies with the client. The coach supports the client in finding their own solutions.

Clarity and goal setting: At the beginning of the coaching, the wishes and expectations of the coachee are discussed. This helps to keep focus and track progress.

Transfer and sustainability: Developed insights and tools are transferred to concrete professional situations, the effect reflected and internalised step by step. In the following coaching session, the results are discussed and expanded accordingly.

Open communication: Open and honest communication between coach and client is crucial. Coaches encourage clients to take responsibility for their own goals and actions.

Resource orientation: The coach supports the client in identifying and using their own strengths and resources to achieve desired goals.

Giving feedback: Constructive and supportive feedback is an important part of the coaching process. It should help to raise the client's awareness, gain new perspectives and promote development.

Ethics and integrity: Coaches uphold ethical standards and integrity. This includes not putting their own interests above those of the client and avoiding conflicts of interest.

Closure of coaching: The coaching process should end with a clear closure phase where results are reviewed and progress is acknowledged.

2. The services provided by the coach or trainer include

Personal Energy Protection

Clients receive concrete, tailored, preventive, basic knowledge and tools that can support them on a daily basis to strengthen themselves and stay strong in order to better cope with stressful situations. In addition, they can work on strategies that support them in communicating, cooperating or leading staff in a more energy-saving and effective way.

Personal Energy Protection Training and Coaching is for health promotion and burnout prevention and not for diagnosing, treating or curing illnesses and disorders. It offers knowledge and tools for general stress management and burnout prevention.

Coaches are not doctors or therapists and coaching/training is not a substitute for medical advice or diagnosis. Clients should always consult their doctor to clarify illnesses. Clients should also consult their doctor  before applying the tips contained in the training/coaching. Liability for personal injury, property damage or financial loss is excluded.

Personal Coaching 

Personal coaching focuses on helping clients to improve their personal work performance, to become more organised and satisfied in their daily work, to protect their stress resilience and to use personal resources and strengths in a more targeted way. 

Business coaching 

Also known as career coaching, this mainly includes coaching concepts that relate to the professional corporate level. In this coaching, clients are supported in improving or expanding their skills in the professional environment. This refers to company-related content such as leadership qualifications and goals, teamwork, but also the organisation and structuring of certain work areas.

Life coaching 

Here, clients are supported in better mastering the challenges of daily life. This includes, among other things, dealing with other people, promoting personal strengths, as well as stress and conflict management in everyday life or personal development processes.

2.1 Each of our coaching/training sessions may contain different elements of the services listed here.

2.2 The exact contents, duration and costs of the services will be specified in an individual contract or in a written offer to the client.

2.3 Limits of the services

The Organiser has qualifications and experience in the coaching field, but is neither a licensed therapist nor a medical doctor. The services consist of personal coaching, counselling and training to promote personal and professional development and are not intended to provide medical or psychotherapeutic diagnosis or to replace medical treatment. Clients should always consult their doctor to clarify illnesses. Clients should also consult their doctor before applying the tips contained in the training/coaching.  

If issues arise during coaching that require therapeutic or medical support, the coach will encourage or prompt the client to contact a qualified therapist or doctor and can assist in locating appropriate professionals if required.

3. Scope of application

The following general terms and conditions apply to all legal transactions of the coach/trainer/organiser, hereinafter referred to as "Organiser", under his contract with his contractual partner, hereinafter referred to as "Client".

4. Subject matter of contract

The Organiser offers coaching events and trainings. A precise description and listing of the range of services, are published in, among other places, the Organiser's business premises and website.

5. Formation of a contract

5.1 A contract with the Organiser is concluded by the confirmation of the submitted offer or the return of the completed and signed declaration of participation by post, by electronic mail or by verbal agreement and subsequent submission of a written declaration of participation.

5.2 For open seminars, each customer shall receive a letter of confirmation after receipt of his/her declaration of participation.

6. Cancellation of participation in a group workshop

6.1 In accordance with the German Distance Selling Act (Fernabsatzgesetz) all contracts concluded by fax, mail, chat, telephone or internet can be cancelled within 14 days of purchase without reason or penalty.

6.2 Cancellation of participation in a group coaching is possible by the customer up to three weeks before the start of the workshop upon payment of a cancellation fee of 50 euros. If the cancellation is made up to one week before the workshop, a cancellation fee of 50% of the event fees will be charged. In case of a later cancellation or no-show, the full workshop fees will be charged.

Cancellation can be made by e-mail or letter. The date of receipt of the cancellation by the Organiser shall be decisive for compliance with the deadline.

6.3 In the case of a workshop organised by a company, the Organiser shall conclude a participation contract with the person responsible for the group or with the person authorised to give instructions about and for the group. In this case the conditions of

para. 5.3 above also apply.

6.4 The Organiser reserves the right to cancel or terminate the event for important reasons. Important reasons include an insufficient number of participants or illness of the event leader. In this case, any event fees paid shall be refunded immediately and in full.

6.5. Right of cancellation of individual coachings

6.6 A contract with the Organiser is concluded following a personal interview, by the confirmation of the submitted offer or the return of the completed and signed offer by post, by electronic mail or by verbal agreement.

If an individual coaching session is cancelled less than 2 working days before the appointment by e-mail or telephone the Organiser reserves the right to charge the full cost for the appointment. The date of receipt of the cancellation by the Organiser shall be decisive for compliance with the deadline.

7 Duration of the contract and remuneration

7.1 The contract begins and ends on the individually agreed dates.

7.2 The fees for the services shall be set out in an individual contract or in a written quotation from the Organiser. Payments shall be made in accordance with the agreed payment terms.

7.3 All payments are due 10 days after invoicing without any deductions. If the payment dates are exceeded, the Organiser reserves the right to charge interest on arrears amounting to 2% of the invoice amount without further reminder. The right to claim further damages remains unaffected.

7.4 Cash expenses and special costs incurred by the Organiser at the express request of the Participant shall be charged at cost price.

7.5 All services provided by the Organiser are subject to the current German value added tax.

8. Scope of services

The scope of services is determined by the respective contract between the organiser and the customer/participant.

9. General conditions of participation

9.1 The customer shall be in breach of contract if, notwithstanding a warning, they persistently disrupts the event or if they behave to a considerable extent contrary to good morals, so that a smooth running of the event cannot be guaranteed. In this case, the organiser reserves the right to exclude the customer from the event and reserves the right to charge the participation fee in full.

9.2 The Organiser is authorised to issue instructions to the participants for the duration of and within the framework of the event.

9.3 The customer undertakes not to be under the influence of alcohol or other narcotics which may impair the ability to react and the physical well-being. In the event of violations of this, the organiser is entitled to exclude the participant from the event and reserves the right to charge the participation fee in full.

9.4 Events and seminars are never without a residual risk. Each client is only insured against an accident within the scope of their own accident insurance.

10. Confidentiality

The Organiser undertakes to treat all information shared by the client in the context of the services as confidential and not to pass it on to third parties without the client's express consent, unless this is required by law. All data is processed on the basis of the applicable data protection laws (see data protection declaration on our website Pasch-Donohoe/en/data protection/).

Although we hope that the participants will share with others the general information and tips that they learn during the workshops the participants agree not to share any personal information shared by the other participants outside of the workshop.

11. Event content and leaders

The organiser is free to change announced event contents. This includes in particular the omission of content or the addition of new content. The selection of coaches/trainers is the responsibility of the Organiser. Coaches/trainers can be changed at any time without prior notice.

12. Working materials

12.1 All materials used or provided during an event, such as scripts, videos, images and sound sequences, are subject to the copyright of the Organiser or other rights holders. Any publication or sharing of the work material requires the written consent of the Organiser.

12.2 Coaching or training materials may not be published or given to third parties.

12.3 In the event of infringement, claims for damages and further claims on other legal grounds may be asserted.

13. Recordings

Photos, Screenshots, Video and audio recordings of the event may only be made with the written permission of the organiser.

By participating in the event, the customer grants permission for photo, video or audio recordings to be made by the organiser during the event. These recordings shall be used exclusively for internal training purposes. A claim to a commission or other payments is excluded unless otherwise agreed in advance and must be in writing.

14. Exclusion of liability

The Organiser accepts no liability for the results or decisions made by the Client as a result of the Services. The Services are intended solely to support and promote personal and professional development. Liability for personal injury, property damage or financial loss is excluded.

15. Changes and termination

The Organiser reserves the right to amend or terminate these General Terms and Conditions (GTC) and the Services at its sole discretion.

16. Applicable Law and Jurisdiction

These GTC are governed by German law. In the event of disputes, the place of jurisdiction shall be Frankenthal, Germany.

17. Final provisions

These GTC constitute the entire agreement between the Organiser and the Client and supersede all prior agreements and understandings. Changes or additions to these GTC must be made in writing.

Should individual provisions of the GTC be invalid or unenforceable or become invalid or unenforceable, this shall not affect the validity of the remaining provisions of the GTC. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come as close as possible to the objective.
